Co-Equality of 3 Branches of NC Government

I will introduce a ballot referendum to amend the NC constitution to allow for the overturning of an NC court decision.  Currently, the Legislature and the Executive branch can be upended by a simple majority (4/7) of the NC Supreme Court.  

I propose an amendment to overturn a Supreme Court decision with a  4/7 legislative majority (rounded up the nearest whole number) and a concurrence of at least 2 of these 3 elected Executive Branch officers - Governor, Lt Governor, or Attorney General.  


Overcoming a Governor's Veto

I will propose a constitutional amendment to reduce the legislative majority needed to overcome a governor's veto from 2/3 to 4/7 (58%)

Immigration

We must sue the federal government in order to prevent the resettlement of refugees, asylum seekers, and illegal aliens in NC without the expressed consent of the Governor and Legislature.  

Amend the Emergency Powers Act

  1. Governor  must clearly explain the emergency, the powers needed, and the timeframe. 
  2. A disaster emergency declaration under subsection (a) shall be in effect for no more than TWENTY-ONE (21) days, unless otherwise extended in whole or part by concurrent resolution of the General Assembly.
  3. Upon the expiration of a disaster emergency declaration, the Governor may not issue a new disaster emergency declaration based upon the same or substantially similar facts and circumstances without the passage of a concurrent resolution of the General Assembly expressly approving the new disaster emergency declaration.

Enact Comprehensive Voter Integrity Law

  • Use of Hand Marked Paper Ballots (HMPB) that are number sequenced, watermarked, and with a MYLAR-wrapped RFID insert (much like our money is watermarked to detect counterfeit vs real). 
  • Ballot production should be as secure as our currency (Ballot Integrity Project recommendations: https://votefinchem.com/announcing-the-ballot-integrity-project/). 
  • Hand count of all paper ballots by volunteers at counting tables with video cameras and in an openly transparent environment (much like used by Arizona during its audit). 
  • Each voter precinct must not have more than 3,000 voters. 
  • ID is required of each voter.  For voters who do not have a driver's license or valid photo ID, the voter must provide his/her address, birthdate, and last 4 digits of SSN when voting in person. 
  • Mail-in ballots are available only to voters who cannot vote in person physically for work-related or documented health reasons.  Mail-in ballots require signature verification by County Election Board staff in the presence of the public.  Mail-in ballots are required to be hand-counted in the same manner as in-person ballots and only on Election Day. 
  • Electronic, online voting is not permitted. 
  • Election Day is a state holiday.
  • State, county, and local government and their employees are prohibited from applying for and accepting monetary and in-kind donations
  • Election counting in each precinct must be completed and transmitted within 2 hours of poll closure.  

Council of States / Constitutional Convention

  • Repeal 17th Amendment.  Revert back to Article I (3) where legislatures elect US Senators.
  • Term limits for Congress
  •  Super majorities in Congress needed for foreign aid
  • Balanced budget
